’CYBER EMPHASIS PRIVATE LIMITED COMPANY’ (hereinafter the ‘Company’) has created and administers the application (hereinafter ‘Electobox’) on the website https://electobox.com. Electobox is governed by these Terms of Use, which shall apply as they are without being subject to any modification by the users. Access to Electobox and the use of the content and services thereof entails the unreserved acceptance of the Terms of Use. As such, any users who disagree with these Terms of Use are kindly requested not to use Electobox.
1. Website Services
1.1) Contact Form
By means of the contact form, users are able to communicate with the Company for any queries or clarifications with regard to organizing a vote, etc. In this manner, prompt response and optimal service to users is achieved. Where a user wishes to use this specific service, he/she shall fill in the respective fields with his/her first name, last name, email address, telephone number, the organization's name, the respective message, and must accept the present Terms of Use and the Privacy Policy of the website.
1.2) Expression of interest form for organizing a vote via the ‘Get Started’ field
The user shall fill in the expression of interest form for organizing a vote with his/her first name, last name, email address, telephone number, the organization’s name, the relevant message, and after the user accepts, with such acceptance being mandatory, the present Terms of Use and the Privacy Policy, the Company shall communicate with him/her either via email or by phone.
1.3) Accessing the Electobox application
Via the ‘Login’ field, voters or vote administrators shall be able, by filling in their user names and passwords, to access the Electobox online environment.
2. Disclaimer
Electobox shall take all necessary measures in order to be a secure environment for users, providing them with valid, reliable and timely information. However, each user shall continue to be fully responsible in terms of assessing whether any content posted on Electobox is correct, irrespective of whether this information is provided by Electobox or by a third party. As such, Electobox shall not be bound nor shall it be liable for any risk or damage (be it actual or consequential) that the user may incur through the use of the content thereof.
3. Third party websites
The website may provide hyperlinks to third party websites. The Company shall not be responsible, in any manner whatsoever, for any loss that may arise from user browsing on third party websites, since users shall continue to be fully responsible for assessing and using any content posted on such websites. The Company shall reserve the right to remove at any time, at its discretion, any relevant links from the Website.
4. Intellectual - Industrial Property - Copyright Restrictions
The entire content on Electobox, including information, services, trading names, marks, images, graphics, photographs, designs, texts, etc. is intellectual property owned by Electobox, protected by the Greek and Union law on intellectual and industrial property, as well as by the respective international conventions. Respectively, the company name, images, logos and distinctive characteristics which are listed and which describe Electobox along with the trademark and/or products and/or services of the Company are the Company's assets, protected by the respective legislation on trademarks. In any event, their view and display on Electobox shall not, in any way, be interpreted as any kind of transfer or licencing. The copy, digital recording, mechanical reproduction, transfer, downloading, resale or creation of derivative works based on this content or misleading the public in terms of the identity of the actual website provider/administrator shall not be permitted. The reproduction, republication, loading, notification, communication or transmission or any other use of the content in any way or by any means for commercial or other purposes shall be permitted only with the prior written permission of the Company or of any other legitimate holder of intellectual rights.
5. Privacy Policy
lectobox shall collect and process the personal information of users when they visit the site, according to the national and Union law on the protection of personal data, in particular according to the General Data Protection Regulation (EU) 2016/679 (hereinafter stated as ‘GDPR’), Law 4624/2019, as well as the Decisions, Guidelines and Opinions issued by the Data Protection Authority. 7. User Undertakings
All users shall be obliged to make use of Electobox in compliance with the present Terms of Use, fair practice and all the rules provided for in the Greek, Union and international legislation. In the event of breach of the below-stated undertakings, users shall be obliged to indemnify the Company for any damages incurred by the Company due to such breach. Specifically, when using Electobox, users shall be obliged to:
- Use the Platform's content in such a way as not to infringe third party rights (individual and social rights), not to offend the personality or violate the privacy of third parties and, at all events, so as not to contradict the law, fair practice, custom and usage;
- Not to mislead any person as to the origin of the content on the Platform and not to damage in any way the Company’s goodwill;
- Not to install, promote and/or distribute content comprising viruses or any other electronic code, files or programs designed to interfere with, damage or restrict the operation of any software for the purpose of hindering other users from using Electobox;
8. Dispute Resolution
The present Terms of Use shall be governed by the Greek Law. In the event that any dispute arises with an Electobox user, the Company shall make efforts to settle this amicably with the user. However, in the event that disputes result in being resolved in court, the courts with material jurisdiction shall be the Courts of Athens.
9. Changes to the Platform
The company may modify, at any time, the content and the services provided via Electobox, without being required to give prior notice to users. Please check regularly the Electobox Terms of Use, since by continuing to use the application, you accept all changes. At the same time, the Company shall reserve the right to inactivate the Platform temporarily for system upgrade and maintenance purposes.
10. Modification to/Update of Terms of Use and Conditions
The Company shall reserve the right to modify unilaterally, at any time, the present Electobox Terms of Use, within the scope of its compliance with regulatory changes, operational upgrades and service optimizations. In any event, all changes, modifications, updated versions, shall be posted promptly on Electobox.
